This Term  Usage sets out the information and conditions of use of our website and services offered by us. This site offers visitors information about Metro Cenografia, its history, projects carried out, photographic records, production technologies, legal information, general conditions of supply for customers and suppliers, and finally, the promotion and dissemination of the brand. By accessing or using our service website, you signify that you have read, understood and agree to be bound by these Terms.

The Services and all materials contained therein or transferred via this website, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto may be the exclusive property of Metro Cenografia and/or the exclusive property of Partners and Customers.

By accessing our content you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works.

You agree to indemnify and hold Metro Cenografia from any claims, losses, liabilities, claims or expenses (including attorneys' fees) made against them by any third party due to, or arising out of, or in connection with the use of the website or any of the services offered on the website or by the company.  

To the fullest extent permitted by applicable law, under no circumstances shall Metro Cenografia be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for lost profits, goodwill, data use or other losses intangible assets arising from or related to the use or inability to use the service, as well as the material presented therein.

To the maximum extent permitted by applicable law, Metro Cenografia assumes no responsibility for any errors (i), errors or inaccuracies of content; (ii) personal injury or property damage of any kind resulting from your access to or use of our service; and (iii) any unauthorized access including use of our secure servers and/or any and all personal information stored on it.

These Terms, the rights and remedies provided herein, and any and all claims and disputes relating to it and/or the services, shall be governed, interpreted and applied in all respects solely and exclusively in accordance with the internal laws of Brazil, State of São Paulo, without respecting its conflicts of legal principles. Any and all claims and disputes will be submitted, and you consent to them being decided exclusively by a court of competent jurisdiction located in Barueri. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

About Privacy Notice

The Privacy Notice describes the types of Personal, Business and Commercial Data that Metro Cenografia collects, the purposes for which this Data is collected, the third parties with which it can be shared and the measures that are adopted to protect the security of the data .

It is important to clarify that Metro Cenografia also acts on behalf and in accordance with the instructions of other partners who act as data contributors or content producers.  

 

Types of data collected in the preparation of budgets, provision/contracting of services, execution of projects and conduct of activities:

  • I - Personal Data relating to an identified or identifiable natural person, in the following categories: 1. Personal Data: name, identity card, cpf, date of birth, address, telephone, e-mail, pis number, affiliation, Civil registration certificates , Tax, among other data; 2. Professionals: professional registration, curriculum, membership card in a professional entity, certificate of courses and diplomas, among others; 3. Financial: bank account number, pix key, among others; 4. Health: evaluation by the occupational physician so that the Holder can carry out his professional activity, among others; 5. Commercial: commercial references in other institutions, consultation in platform databases such as serasa, notary offices, among others; 6. Photographic Registration for personal identification and 7. Other credentials may be requested;

  • II - Business Data relating to a company, institution or business economic group, in the following categories: 1. Complete Registration Form including data on its directors, administrators, directors and managers; 2.Commercial and Tax registration certificates; 3. Commercial: commercial references in other institutions, database consultation on platforms such as serasa, notary offices, among others; 4. Financial: bank account number, pix key, among others; 5. Commercial Portfolio; 6. Productive and Financial Capacity Information; 7. Photographic Records; 8. Other credentials may be requested;

  • III - Commercial data used in the preparation of budgets and proposals, in the following categories: 1. Architectural projects; 2. Photographic records of processes, people and/or executions; 3. Project reports; 4. Descriptive memorial; 5. Documents originated by technical consultants; 7. Other data may be needed to format the briefig.

 

Other data necessary for conducting business, preparing commercial proposals, preventing and controlling fraud, risk management, dispute resolution and other related purposes may be collected or used. These data will be used to manage the contractual, commercial or employment relationship with the Holder in making the registration of Employees, Suppliers, Service Providers and Customers.

Such information may be shared with:

1. Partners, when necessary to prepare budgets and registers;

2. With customers or suppliers, when necessary authorizations for access to the place of service provision or participation in closed meetings;

3. To carry out the administration and conduct of activities;

4. To agencies, public entities and regulatory entities, in accordance with current legislation;

5. Whenever requested by competent authorities;

6. To carry out due diligence, reports, technical, administrative, accounting, billing and legal reports;

7. Manage the contractual relationship;

8. With employees in the exercise of their functions;

9.  With information technology system providers, cloud cloud service providers;

10. With third parties for quality and productivity purposes;

11. With business partners that together with Metro Cenografia offer products and services;

12. With insurance companies and insurance brokers;

13. With any third parties to whom Metro Cenografia has transferred rights and obligations, such as consultants, lawyers, accounting firms, sales representatives, clients;

14. For other purposes for which specific notice is provided at the time of collection as required by law.

How We Use Cookies

Metro Cenografia uses cookies to facilitate the use and better adapt its website and applications to the interests and needs of its Users, as well as to help and improve its structures and contents. Cookies can also be used to speed up your future activities and experiences on our services.

Metro Cenografia does not sell Personal Data as provided for in the Data Protection Law.

Personal, Business and Commercial Data may be accessed or transferred to any national or international authority, public body or court, if such access or transfer is required in compliance with applicable law or as a result of a request or request from any mentioned entities .

The Holder may withdraw any consent that he has previously granted in relation to the processing of Personal, Business and Commercial Data at any time and free of charge. The Holder's preferences will apply, although the revocation of consent does not affect the legality of any previous treatment or those required by law.

The Holder may request information about the Data that Metro Cenografia keeps, update, rectify inaccuracies or eliminate Personal Data whenever necessary. If the Holder is not satisfied with the way in which Metro Cenografia treats Personal, Business and Commercial Data, the Holder must contact us by providing personalized information on the matter. The question will be reviewed and answered within a reasonable time and as required by law.

The security of Personal, Business and Commercial Data is important for Metro Cenografia. We are committed to protecting the information of our partners, customers, suppliers, service providers and employees. Appropriate administrative and technical measures are applied to protect the data that is provided or collected against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

This Privacy Notice may be periodically updated at our sole discretion. Metro Cenografia will notify you through a notice on the website, to give the Holder knowledge of the changes before they become effective. Your continued use of the Site or our service after any change constitutes your acceptance of the new Terms. If you do not agree with any of these terms or any future version of the Terms, please do not use or access (or continue to access) the website or service.
